Probate is the term used for the process involved in administrating and dealing with the estate of a person who has passed way. The estate may involve dealing with the assets and discharging any liabilities of the deceased person. We can deal with an estate for a person who has passed away with a Will and those who have passed away without a Will. Our service can provide initially the fact finding process of valuing the estate, completion of the relevant forms to include the Oath, tax forms, obtaining of the grant from the Probate Registry and the distribution of the estate. We also provide a full and comprehensive set of estate accounts.

While we provide a professional service we appreciate the need for a sympathetic approach at a very sad time obviating the additional stress of a legal necessity during a grief stricken time.

We provide a complete Will writing service, to include advice on Executors, gifts, Guardians, charitable gifts, property , beneficiaries and exclusion of family members. Our service includes advice on the different types of trusts you can set up to cover immature beneficiaries, disabled beneficiaries and beneficiaries who may have issues such as drug and alcohol dependency.

Our fees will include the advice given, the drafting and signing and witnessing of the Wills together with storage.

We also provide a home visit service for those who are housebound.

We can provide full estate planning allowing you to plan during your life time by making appropriate gifts which are potentially exempt from Inheritance tax. Our service will also provide advice on the preparation of a Will to include inheritance tax provisions if need be in order to reduce tax liability.

Since the new law in October 2007, Enduring Power of Attorneys were replaced with Lasting Power of Attorney. Although the Enduring Power of Attorneys in existence can still be used.

Our service provides advice on the new law, completion of the relevant documentation and advice for the attorneys. Please note any Enduring Power of Attorney draw up prior to the changes can still be used.

When a person has no capacity to appoint another person to deal with their affairs and welfare, a family member or friend who wishes to take on the responsibility will need to apply to the Court of Protection to be appointed as a Deputy.

Our service provides the following:

  1. Completion of all documentation for the application for a deputy order
  2. Application to reject an application made to the Public Guardianship Office
  3. Registration of an Enduring Power of Attorney
  4. Assisting with the preparation of the deputy's accounts
  5. Dealing with the estate of a deceased person whose assets are held in Court funds

We can provide advice in relation to transfer of a property during your lifetime. Also the difference between joint and shared ownership of a property and advice on those considering equity release loans.
